# Terms and Conditions (T&C) for Fynnley.art ## 1. Scope These Terms and Conditions (T&C) govern the use of the commission service provided by Fynnley.art (hereinafter referred to as "the Service"). By using the Service, you acknowledge and agree to these T&C in full. ## 2. Submitting a Request 2.1. After submitting a commission request, we will contact you via your selected communication method within three (3) business days. 2.2. Requests are processed on a first-come, first-served basis. 2.3. You may cancel your request at any time before the first sketch is delivered. In such cases, a full refund will be issued. ## 3. Revisions 3.1. Customers may request an unlimited number of revisions. However, we reserve the right to deny revision requests if we determine they are being used in bad faith (e.g., attempting to obtain multiple variations through excessive changes). 3.2. Revisions should be limited to minor adjustments. Requests for major changes such as altering the character's body type or switching the commission type will be considered a new commission and are not covered under the revision policy. ## 4. Usage Terms 4.1. You agree to use the Service in compliance with applicable laws and these T&C. 4.2. Any violations, inappropriate behavior, or breaches of these T&C may result in immediate suspension or termination of your access to the Service. ## 5. NSFW Content 5.1. We accept NSFW or explicit content commissions, including a variety of kinks or fetishes. 5.2. We do not accept requests for illegal content, including but not limited to depictions of minors, excessive gore, or drug use. ## 6. Ownership of the Artwork 6.1. You may use, share, and modify the commissioned artwork for personal purposes, provided that the commission was paid for and not refunded. 6.2. Commercial use or resale of the artwork is strictly prohibited. ## 7. Changes to the T&C 7.1. We reserve the right to update or modify these T&C at any time. Changes will be posted on our website and become effective as of the date of publication. ## 8. Final Provisions 8.1. In the event of any legal disputes, the jurisdiction shall be the location of our company headquarters, provided the user is a merchant, a public legal entity, or a public-law special fund. 8.2. Unless conflicting with mandatory legal provisions in your country of residence, German law shall apply. The UN Convention on Contracts for the International Sale of Goods (CISG) is excluded. 8.3. The European Commission provides a platform for online dispute resolution (ODR), available at: [https://ec.europa.eu/consumers/odr](https://ec.europa.eu/consumers/odr). We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board. 8.4. Should any provision of these T&C be found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
